Man taken into custody on theft charges

A Texas man was taken into custody for a second time by U.S. Marshals in connection with the alleged theft of several valuable items including a boat valued at about $200,000. According to officials, the defendant allegedly broke into a storage facility belonging to a family member and stole a bulldozer and more than one vehicle in addition to the boat. The storage facility is located in Denison on North Highway 91 in the 4400 block.

The accused man is now facing three charges of theft including the burglary of a building and theft of at least $200,000. He was reportedly taken into custody on an affidavit of surety connected with his bond. He remained in custody on a bond of $250,000. According to police, they started their investigation in June.

The penalties for a theft conviction may reflect the amount of property loss. Depending on the value of the items that were allegedly stolen, a person convicted of theft charges may face prison time in addition to fines and probation. In order to win a conviction, the prosecution will need to prove beyond a reasonable doubt that the defendant intended to take the item or items. Potential proof may include surveillance footage, police reports and documented statements.

A criminal defense lawyer may review the prosecution's evidence to determine whether to proceed to trial or negotiate a plea deal. If the lawyer is concerned that the prosecution has compelling evidence, he or she may advise the defendant to accept a plea agreement. This would allow the defendant to avoid a trial; however, he or she might be required to plead guilty.
