Drivers License Suspension

Richmond Driver's License Suspension Lawyer

Worried About Driver’s License Suspension After a DWI Arrest?

For many people, the prospect of losing their driver’s license is the worst consequence of a drunk driving arrest. License suspension is embarrassing and inconvenient and may cause problems for employment.

The Law Office of Larry McDougal has successfully represented clients in administrative license revocation (ALR) hearings to prevent or minimize the loss of driving privileges. Many defendants — and many lawyers — overlook this separate administrative process. It is not only an opportunity to fight the suspension, but a valuable opportunity to gauge the merits of the prosecution’s evidence for the criminal DWI proceedings.

You must act within 10 days. To challenge your license suspension, you must request a hearing within 10 days of your DWI arrest. We handle DWI defense, including representation in ALR hearings, throughout Fort Bend County, Texas.

Fort Bend County Law Firm for Driver’s License Revocation Hearings

On a first-time DWI, a person’s license can be suspended for 90 days or for 180 days if the person refuses the blood or breath test. If the person’s blood alcohol was measured at .15 or greater, the court can require an ignition interlock as a condition of reinstating driving privileges. On a second DWI offense, license suspension is six months (or one year for refusal). Subsequent offenses result in revocation for a year or more.

The license revocation hearing is a separate administrative process. You can win your ALR hearing even if you are convicted of DWI, and you can lose your driving privileges even if your DWI case ends in dismissal or acquittal. On a repeat DWI, however, you are subject to a mandatory conviction suspension as well as the administrative suspension.

In an ALR hearing, there is a lower burden of proof than in criminal court. However, you have a right to call witnesses and cross-examine the arresting officer. Attorney Larry P. McDougal Sr. is a former law enforcement officer and former prosecutor who knows how to make the most of an ALR hearing to give you the best chance at keeping your license.
